Abstract

The clementia Caesaris in the Pro Marcello is studied in order to explore its consequences as far as the identity of the participants of the dialogue, namely Caesar, Cicero and the rest of Pompeians who were pardoned by the victor of Pharsalia. It is to be noted that the fruit of this clemency, Marcello's pardon, is presented as the result of a reflexive act in which military praxis and politics are combined. Such representation implies a tension between clementia and iustitia that sheds sorne light on the constitutional crisis. To consider the pardon as beneficium affects the identity of the agents of the discourse and emphasises the fracture of the rule of the law.
