Abstract

The Gortyn law concerning damages caused by animals allowed the owner whose animal had been injured by another to accept «the noxal surrender» or an indemnity. Likewise, the master of a delinquent slave had noxal liability and he could be sued for damages caused by this. Thus, the purchaser should assume responsibility for his just bought slave’s offences unless he rescinded the purchase. If not, the victim would have to bring a suit against the new owner of the slave and not against the former, although his act had been commit before the transfer of ownership, as in the Roman law.
