Abstract

This work tries to show the structural community that, from the philosophical point of view characteristic of hermeneutics indebted to the method of André de Muralt’s structural analysis of thought, exists between the models of discursive ethics of fundamentation and explanation of politics (specifically of justice), expressed in Jürgen Habermas’s theoretical postures and those of Karl-Otto Apel, and the modern contractual models. Ultimately, it seeks to show the close philosophical bonds existing between both in order to clarify the current philosophical-political and philosophical-legal discussion, where these models have a special strength, to verify finally that it is variations (more or less sophisticated) on the same theme, already shown in Modernity.
