Abstract

Ya'iha is a juridical term referring to calamities suffered in rural communities. Declaration of state of ya'iha when an accident destroys a third of fruits results in the total or partial cancellation of a contract or some of its clauses, but opinions of experts differ; after giving the sources used for this study, a list is offered with calamities acceptable to maliki jurists as reason for declaration.
