Prison sentence: reflections on its exceptionality and alternatives

Abstract

Starting from a brief historical trail on the basis of the prison sentence, with brief references to the sentence theories, both the exceptionality of the life sentence and prison sentences in general are asserted, which should be an exception in penal codes these days, considering with more broad-mindedness the alternatives as the suspended prison sentences, fines, communitary works, house arrests and custodial sentences involving deprivation of rights and, in any case, deprivation liberty sentences for short times should be erased.
