Abstract

The main ideas of Hans Kelsen and Carl Schmitt about war and peace in international relations are, in this article, unfolded starting from the idea of ‘juridical pacif ism’. Their usefulness for the contemporary  debate on “humanitarian  war” and on “war against terrorism” is also assessed.
