THE CURRENT SITUATION OF FEMINIST LEGAL ANALYSIS IN THE LIGHT OF RECENT JUDICIAL DECISIONS

This paper defends the need and importance of the feminist analysis of the Spanish legal system, in spite of its having already introduced antidiscrimination policies. Although feminists have repeatedly denounced legal dynamics which are prejudicial for women, this article illustrates, using recent judicial resolutions, that the vast majority of purposes of the feminist critique have still not been exhausted. The judicial decisions analyzed show how criminal law and its application by courts is still male, how feminine stereotypes continue to play a central role in decisions about custody issues and how courts give little credit to the woman’s word in cases of sexual violence.
