Abstract

This paper deals, firstly, with the importance of including the social dimension in legal analysis based on a rigorous interdisciplinary approach that allows to articulate the methodological requirements of each science and avoids syncretism (I). Then, it will be developed how Nathalie Heinich’s sociology of values can be a relevant theoretical-conceptual framework to provide objectivity/rationality to the legal discourse when arguments of a social nature are incorporated (II). Finally, it will be argued that what has been exposed in the previous section allows the inclusion of a relevant tool when arguing and justifying the decision of hard, very hard and structural cases in which, among other aspects, legal principles should be used (III).
