Análisis crítico de algunas definiciones comunes del concepto de soft law

El objetivo del presente trabajo es analizar críticamente alguno de los conceptos de soft law más difundidos en la literatura como paso previo necesario para formular una definición que sirva para mejorar nuestra comprensión sobre el soft law. Para ello, en primer lugar, afirmaré que los intentos de definición extensional de la expresión “soft law” tienen el problema de, bien ser inmanejablemente largas, bien terminar convirtiéndose en definiciones intensionales vagas. A continuación, presentaré dos definiciones de soft law ampliamente compartidas por la literatura (Snyder y Senden). Posteriormente, dividiré dicha definición para su análisis crítico en tres partes: el soft law es un conjunto de reglas de conducta; el soft law no es jurídicamente vinculante; y el soft law puede producir efectos prácticos y jurídicos (estos últimos, solo indirectos). Concluiré sosteniendo que las propiedades identificadas por estas definiciones no sirven para caracterizar adecuadamente el soft law
