Abstract

This paper analyses and evaluates with a critical perspective is the content of the content of the Tourism Law of Catalonia, which was approved in June 2002. First of all, the determining factors of the law are explained, specifically the role of the public administration in the developement tourist sector, the role of the territory in the tourist policy and the new coordinates of the public tourism management. Afterwards analyse the treatment of the tourist realities of the territory within the law with the result of four considerations: the law comprises an incomplete diagnosis of the tourism in Catalonia, which leads to the definition of leaning purposes; it gives a conventional treatment of the tourist resources; it establishes as tourist zonification of the territory which is inconsistent with the reality and, finally, the law contemplates an inadequate attribution of the competences between the different administrative levels.
