Abstract

This paper analyses electoral systems as the great challenge of political science, up to the point of considering them the most important branch of the field. One of the central themes analyzed in this project is the role and functions attributed to the constitutional jurisdiction of electoral systems in both Germany and Latin America. For this purpose, the author develops a thorough analysis and study of the different electoral systems and the functions that they must comply with and fulfill. The recommendation that is carried out in this work focuses on all possible roles, without prioritizing any. This will require a notion of “balance”, in the words of the author, when considering a constitutional ruling on the judicial order. Constitutional jurisdictions may only then combine the necessary variables, both functional and contextual, that have marked most of the controversies in this field.
