Form, seen first and foremost as corporeality, but also as the mode of being of a thought or an expression, is an opportunity to consider a material study of law. Behind ideas such as text and fiction, this paper offers an alternative reading of the history of legal thought. Indeed, and also with the backing of Pierre Legendre’s approaches, the following research attempts to open the reader to the possibilities of fiction, its presence in legal discourse and the institution as a linguistic montage as a possibility of law. For this we will pass through the material dimension of law, beyond the form understood by legal formalists and positivists who rely solely on the possible ways in which law takes shape and prevails. Finally, we are interested in the textuality of law and its record of historical, literary and linguistic modulations.
